BARD Marketing Executes Election Campaigns for Clients Running for Seats on the Board of Directors for the Palm Beach County Bar Association

DELRAY BEACH, FL – Beyond All Reasonable Doubt (BARD) Marketing, a legal branding, marketing and advertising agency, customized and executed two Election Campaigns for clients—Personal Injury Attorney Jason J. Guari and Appellate Attorney Robin I. Bresky—running for seats on the 2010-11 Board for the Palm Beach County Bar Association (PBCBA).

The election campaigns were strategically constructed and customized per client. Ads on behalf of each candidate were designed and inserted into Bar publications, press releases were written and distributed to appropriate media outlets, and email campaigns were forwarded to Bar members announcing their candidacy and each of the candidates’ platform for office.

Jason was re-elected and had served on the Board of Directors for the last two (2) years. As a Director, he oversaw CLE and has been working with the Bar’s Building & Planning Committee to ultimately secure its own Bar building. For his upcoming term, he will be working with Bar leadership regarding the possibility of implementing the PBCBA – Foreclosure Mediation Program.

Robin was Chairperson of the 2010 Bench Bar Conference, and past chair of the PBCBA Appellate Practice Committee. Her campaign platform was to be the voice and represent the interests of the PBCBA members; serve as a leader committed to implementing programs and activities that benefit the Bar’s members; and help to increase the PBCBA’s support and participation in more community outreach programs.

The Bar’s elections for Board of Directors were conducted online. Each member in good standing received an email with information on how to vote. Voting began April 15, 2010 and ended at 5 p. m. on April 26, 2010. The four highest vote totals will serve a two-year term and the fifth highest will be for a one-year term. Successful candidates will be sworn in at the Palm Beach County Bar’s annual installation banquet at the Breakers Hotel on June 12, 2010.

Boutique Law Firms, Solo Practitioners Find Value in Working with
Legal Marketing Experts, BARD Marketing

Palm Beach County, FL – With the ever-increasing competition among law firms across most practice areas, law firms are realizing that they need to place a greater emphasis on marketing and business development, in some form. Unfortunately, many small, boutique law firms assume that they have neither the time nor the resources to establish a strong brand, effective website or ongoing marketing program.

To address the needs of these firms, BARD Marketing has recently launched a program tailored to these firms. The Boutique and Solo Program provides the crucial marketing program elements that small firms require to establish a strong brand and successfully thrive in the competitive legal environments. Further, BARD also provides both strategic advice and practice-management guidance, acting as a trusted advisor to these firms.

“Often, small firms don’t know where to turn,” said BARD Marketing president John Sailer. “They need more than just a website. They need a brand, a strategy and an integrated program. But they also need it to be affordable.”

BARD client and attorney Mike Liss agrees. “What I’ve found in working with BARD is a strong mix of strategic thinking, legal industry knowledge and top-notch web and marketing design,” says Liss, who runs a solo family law practice. “But not only that, they were critical in helping me develop a strong brand. This alone paid immediate dividends in setting my firm apart from my competition.”

BARD Marketing recently launched a number of websites for boutique law firms and solo attorneys in this program. These sites included: The Law Offices of Michele Cavallaro, PA – Dania Beach, Florida; The Law Offices of Mike Liss, P.A. – Boca Raton, Florida; and Sidney Turner, LLC – West Palm Beach, Florida.

BARD Marketing offers integrated marketing and advertising services, including website development. New Websites Launched by Legal Marketing Agency Incorporate Digital Asset Optimization to Increase Competitive Internet Presence

Palm Beach County, FL – It’s no secret that law firms who are successful in marketing themselves need an Internet presence, but recently, it’s become increasingly important to offer site visitors more than just basic content to maintain your place on the web and convert clicks to clients.

To be found on the web and have an effective Internet presence, firms need to do more than the basic search engine optimization—the time has come for digital asset optimization (DAO). With “digital asset” additions to their sites such as blogs, videos, online photo galleries and more, attorneys and law firms can compete on the web—regardless of the firm’s size.

“By focusing only on traditional Search Engine Optimization, law firms are missing opportunities to be found on the web,” said BARD Marketing president John Sailer. “Streaming videos, blogs, photos, press releases and other online content are being searched for, and most websites don’t account for these other media types. Remember, YouTube recently overtook Yahoo to become the second largest search engine behind Google. This trend is only going to grow.”

BARD Marketing recently launched a number of websites for leading law firms that feature these digital elements, which increase the effectiveness and usefulness of each site to the user. The sites include: Alpizar Law – Palm Bay, Florida; Edward

M. Ricci, P.A. – West Palm Beach, Florida; and the Suskauer Law Firm – West Palm Beach, Florida.
Alpizar Law, a personal injury and insurance bad faith firm in Palm Bay, Florida, caters to a bilingual clientele, and providing only limited information in Spanish isn’t an option. To address this need, BARD Marketing created a mirror site to their English website, www.alpizarlaw.com, in Spanish. The Spanish site utilizes the same web address and offers the same depth of information and content. As importantly, both the English language site and the Spanish language site offer custom created streaming videos to provide answers to common legal questions in video form.

Edward M. Ricci, P.A. launched a new site, located at www.edriccilaw.com that incorporates a Safety & Justice Blog that provides timely information to consumers on current topics, legislation and news in personal injury cases that affect the audience.

For the Suskauer Law Firm, a prominent criminal defense firm in West Palm Beach Florida, BARD developed a new website www.suskauerlaw.com, with the YouTube generation in mind. The site features several multimedia capabilities, to support television, radio and print media coverage rather than just being a repository for page after page of copy.

BARD Marketing offers integrated marketing and advertising services, including website development. All services are designed to complement one another and form a structure of synchronous marketing efforts that collectively increase leads for law firms. BARD offers a no-cost, no-obligation review of current sites and promotional materials, and can share innovative strategic concepts, during this review.

LEGAL MARKETING AGENCY OFFERS TIPS FOR LAW FIRMS ON DEVELOPMENT OF 2009 MARKETING BUDGETS – ADVISES AGAINST CUTTING CORNERS

Palm Beach County, FL – With the end of the year approaching and the uncertainty of the economy, legal marketing agency Beyond All Reasonable Doubt Marketing is advising law firms to take a serious look at their budgets. While marketing, advertising and public relations dollars frequently are cut to reduce expenses, marketing experts agree that a down economy is actually the time when marketing efforts should remain in place, and if anything, be enhanced.

“When other law firms reduce their spending and cut their marketing, they have less presence in the marketplace,” explains BARD Marketing founder and president, John Sailer. “This means the time is ripe for a savvy law firm to grab market share – to reach the audience that is still there but who is hearing from fewer of your competitors.”

When planning your law firm’s budget, you should start by identifying how much you want to spend. While there are no hard and fast rules across the different types and sizes of law firms, it makes sense to budget your marketing as a percentage of expected revenue. Several studies have pegged overall law firm marketing budgets to be between 2 percent and 3 percent, with leading firms spending 5 percent or more.

Second, prioritize your initiatives by looking at both costs and expected benefits. This is easy if you tracked your efforts in past years. Remember that some of the lower cost initiatives may bring strong value while some of the higher cost initiatives may bring very little value. With this said, it is imperative to track outcome of every initiative.

BARD Marketing is experienced in budgeting and planning for short- and long-term marketing and advertising plans, and enables law firms to achieve and track ROI for their marketing activities. Legal Marketing Agency Shares the 7 Deadly Sins of Newsletter Production
Consider a New Twist on an Old Standard for Your Law Firm’s News

PALM BEACH COUNTY, FL – Every month, mailboxes across the country are crammed with newsletters from all sorts of businesses. Some of these newsletters get read and provide the intended value for the sender and reader, but many others don’t and end up in the trash. Beyond All Reasonable Doubt Marketing has brought the classic newsletter out of the marketing closet, dusted it off, and given it a fresh new style by avoiding common mistakes and tailoring it to individual recipients.

When the “Seven Deadly Sins” of newsletter production are followed, the new newsletter can prove a valuable tool for promoting law firms and bringing cases and clients. These sins are:

1. Thou shall not create a “brag rag.”
While communicating successful trials and settlements helps validate your credentials, this cannot be the only focus. Your newsletter needs to focus on your readers and their needs, not just recent courtroom victories.

2. Thou shall not appear lazy and send out newsletters infrequently.
Newsletters, like all advertising, accumulate results through frequency. To keep top of mind with readers and build a connection over time, your newsletters have to be published consistently – whether monthly or quarterly.

3. Thou shall not be aimless.
Editorially, you can’t just fill your newsletter with random “stuff.” You must strategize and create a specific editorial calendar of information that you want to include. “Filler” copy will turn off your readers.

4. Thou shall not be tedious.
Find interesting and diverse topics to include. Variety is critical to a good law firm newsletter.

5. Thou shall not be unfocused.
Mass mailings to all the different groups of people in your database is inefficient and ineffective. A generic message to a general audience is a waste of money. Focus on specific messages to specific audiences. A highly targeted approach will beat a shotgun approach ever time.

6. Thou shall not be penny wise and pound foolish.
Avoid the tendency to print and send out as many newsletters as possible, while trying to cut costs on design and production. High quality printing and production will pay off.

7. Thou shall never forget that the benefit you receive is based on the value received by the reader.
A high quality newsletter with articles that benefit the reader will have a greater impact on your phones ringing, while a low quality newsletter with little information will be ignored. Focus on the readers – their needs, wants and interests.

Beyond All Reasonable Doubt Marketing is experienced in creating high-quality newsletters and e-newsletters for law firms, including content writing, layout and design, list management, printing and mailing. We have introduced Variable Document Printing that allows you to personalize your newsletter to segments of your audience, or even to the individual – at an affordable price. This new twist on the time-proven traditional newsletter can increase your readership and response.

Websites are More Important than ever for Law Firms –
Recent sites created by legal marketing agency BARD Marketing

PALM BEACH COUNTY, FL – Internet marketing is a major, multi-billion dollar industry. Consumers have the skills and confidence to use the Web on a regular basis. An Internet presence has become essential. Yet many law firms are disappointed in their websites performance, according to legal industry marketing experts, Beyond All Reasonable Doubt Marketing.

“There can be many reasons for the lack of website performance,” explains BARD Marketing President John Sailer. “Poor website construction that is not search-engine friendly is one reason; along with poor targeting and branding; lack of informative, interesting, well-written content; and hierarchies that aren’t user friendly,” he adds.

“Many law firms – both large and small – have been coming to us to either to establish their presence on the web, or because their current site just isn’t working, and they don’t understand why. Some firms even come to us because their current website content is templatized and generic.”

Sailer’s agency agrees with recent reports that show “local search” growing in importance. This is the ability to readily find a business online that is in close geographic proximity to the web user’s home or business. Strong local search is particularly important for law firms in Florida and across the US, given the ever-increasing competition among firms. For this reason it is important, when creating a website to view search performance holistically, looking at the firm’s branding, website content and website design. “There isn’t one single bullet to strong search performance, but a lot of factors that all come into play.”

BARD Marketing has also found that a majority of law firms do not accurately measure and thus do not know the actual success and performance of their website. Sailer advises that all firms need to monitor their website performance to ensure ongoing improvement. In addition, fresh content should be added, ideally at least once a month.
South Florida law firms who recently launched new websites created by BARD Marketing include: Alpizar Law – Palm Bay; Balkan & Patterson – Boca Raton; L. D. Murrell – West Palm Beach; Murray & Guari – West Palm Beach; Slawson Cunningham Whalen & Gaspari – Palm Beach Gardens and the Romano Law Group – Lake Worth Florida.

Attorney Scott Murray states, “Since BARD created our new site, we have seen the number of visitors to the site increase, and many of them contact our firm. We have had associates comment on our informative videos and other dynamic elements of our site. We couldn’t be more pleased with it.”

In summary, no business or organization can ignore the importance of having a high-performance website and maintaining a web presence.

BARD Marketing offers a full range of marketing and advertising services, including website development. All services are designed to complement one another and form a structure of synchronous marketing efforts that collectively increase leads for law firms. Law Firms Can Still Implement Marketing in a Down Economy —
Legal Marketing Agency Offers Suggestions

PALM BEACH COUNTY, FL – Marketing and advertising vehicles like TV ads, billboards, newsletters and the like are typically costly. Not all firms can afford these items, especially in a slump. Still, law firms need to aggressively market themselves because competition is fierce. Beyond All Reasonable Doubt Marketing, an agency serving the legal industry, offers good news for law firms on a budget: There are several low cost marketing techniques that can be used by firms trying to save money in a down economy, or by any firm as part of a larger marketing program.

1. E-newsletters
Newsletters keep your firm top-of-mind with past clients, associates and referral partners, as long as you are sending them on a regular basis. E-newsletters perform a similar role and can be sent using an inexpensive online service. Good writing and layout is important.

2. Blogging
Blogs may have been overhyped during the past couple years, but the fact remains that a well-written blog tailored to a specific audience will be found and read. Blog syndication, along with the viral effect of a timely, interesting blog can lead to several thousand (if not more) interested readers. And, blogs are very low cost.

3. Networking
You encounter people every day, some of who may need your services today, or will need them in the future (or have clients or friends that need your services). Are you maximizing these encounters? If you go to a Bar function or other event, make an effort to talk to people other than those you know and always talk to. Fine-tune your ‘elevator pitch,’ bring business cards, and be outgoing. Offer to help people that you meet. Whether it’s providing an introduction to someone that you know or providing advice to help solve some problem, demonstrating to a new acquaintance that you can provide value is a surefire way of making a positive impression and being remembered.

4. Focus on past clients
As many attorneys will attest, past clients are often the best referral sources. That said, it is amazing how many law firms do not focus on past clients, aside from sending the ubiquitous holiday cards. For those firms, now is a good time to update your client database. Verify their most recent addresses and phone numbers. Gather their email addresses. Develop a strategy of meaningful, consistent communication with past clients of about three to four times a year. If you have not done so recently, it is a good exercise to survey your past clients. You might be amazed at the return-on-investment that this exercise provides in terms of new referral cases.

5. Public Relations
PR has two strong advantages as a marketing mechanism for many law firms. First, it can be substantially lower in cost than most forms of marketing or advertising. Secondly, whereas advertising is a message created and paid for by the advertiser, PR coverage is generated by independent parties who have high credibility – the media (whether television, radio, print, or online). Consumers do not see media coverage as advertising, yet you are being promoted.

These tools and many others are low cost and can be used to great effect. Like all things that can bring value, success requires a plan and consistent follow-through. Beyond All Reasonable Doubt Marketing is experienced in developing and executing strategic marketing programs for law firms of all sizes and varying budgets. Phone: 1-888-922-7398. Legal Marketing Agency Examines ROI of Yellow Page Advertising

DELRAY BEACH, FL – With the high cost of advertising and the potential low return if the advertising misses the mark, the legal marketing experts at Beyond All Reasonable Doubt Marketing began an examination of yellow page advertising for law firms and attorneys. What they found was that the return on the investment for large yellow page ads did not warrant the cost in the majority of cases.

“What’s clear is that, while yellow page advertising costs have not been lowered in a decade, and in most cases have increased…use of the yellow pages and similar directories has dropped. With less people looking at printed directories, you would think the advertising rates would fall in line,” comments John Sailer, founder and CEO of BARD Marketing.

He adds, “Many of our clients have an impression that their yellow page ads are working but when intake tracking measures are put in place, they are surprised to see how few new leads come from these expensive ads. While yellow page advertising is right for some law firms in some cases, we encourage law firms to look at how those funds could be better spent on other marketing vehicles that generate more inquiries.”

Given that some law firms do get a return for their yellow page investment, Sailer encourages them to enhance and improve their lead-tracking so that an accurate determination can be made. In addition, he asks law firms to consider that there may be more proactive solutions for marketing as opposed to waiting for someone to see your ad in a book that’s full of ads.

BARD Marketing offers a full range of marketing and advertising services, including public relations. All services are designed to complement one another and form a structure of synchronous marketing efforts that collectively increase leads for law firms. Speicher will provide a variety of marketing tasks including research and strategic planning, image and content development, copywriting, editing, and concepting.

BARD Marketing tailors marketing and branding plans for attorneys and law firms. The agency’s founders, marketing veteran Kim Sailer and branding expert John Sailer, are thrilled at the reception they have received in the legal community, and with the agency’s need for additional staff and services.

“Clearly there is a need for an agency like ours, that can invest the time in marketing that busy attorneys can’t,” commented Kim Sailer. “Understanding and targeting their audiences are tough challenges for law firms to address, and BARD Marketing has that experience. We take that burden off their shoulders.”

“As Marketing Manager and Copy Specialist, Priscilla Speicher will assist with creation of all promotional activities and materials, and ensure that all projects meet the client’s needs and deadlines”, adds John Sailer.

Speicher is a 12-year resident of South Florida with 19 years of marketing and communications experience. She holds a Bachelor’s Degree in Journalism and is a member of the Delray Beach Chamber of Commerce. She has written and concepted marketing materials for major companies and organizations in the automotive, healthcare, financial, travel and hospitality industries, as well as the non-profit sector.

Newly founded company will aid law firms in responding to
and reversing declining public image and overcoming increased competition

DELRAY BEACH, Fla. — Florida law firms face considerable competitive challenges. These include attacks from other interest groups through advertising, public media campaigns, direct mailing, blogs, emails and countless other communications tools. This is resulting in worsening public opinion. Add to this intense competition, tort reform, educated consumers and the influence of technology. These challenges are changing how legal services are viewed, legal firms considered and counsel is chosen. Given this environment, law firms cannot expect to grow and prosper anymore simply by advertising in a yellow pages directory or airing television commercials, whether consumer litigation, criminal representation or a strictly civil law practice.

With this in mind, law marketing veteran Kim Sailer and branding expert John Sailer recently founded Beyond All Reasonable Doubt Marketing. “This is a new concept for a marketing firm said Mrs. Sailer. “Our firm is catering exclusively to the legal profession in a focused and targeted approach and from a proven platform. There are many companies that can help law firms develop a website or create an advertisement, but few that can holistically develop a marketing strategy,” she added.

“There existed a compelling need for a firm that had the experience, tools, skill and understanding to assist law firms with the development and successful implementation of a competitive marketing program,” said Mr. Sailer. “A law firm in this day-and-age must seize their competitive advantage, articulate their value proposition and develop a comprehensive marketing strategy that is directly tied to their business – which is that of the practice of law and the delivery of that specific service. That’s what we are here to do,” he added.

“Marketing strategy is an afterthought for most law firms, either because the attorneys are too busy or don’t know where to begin,” added Mrs. Sailer. “Consumers are savvy; however law firms who compete for their business provide very little information in order for those potential clients to make informed and accurate decision,” she added.

Beyond All Reasonable Doubt Marketing is ready to grown quickly because at this time leading firms understand that consumers are grappling at making a decision about hiring a law firm, and that in order to capture business and grow a law firm and revenue stream, they now have to have a successful and targeted marketing strategy. “We are here to help these firms in marketing themselves. Allowing lawyers trained to practice law to do just that while also having an eye of the competitive edge of the business,” concluded Mrs. Sailer.

Kim Sailer Presented to the Palm Beach County Bar Association
– How to Market Solo & Small Law Firms –

DELRAY BEACH, Fla, — Kim Sailer, partner in Beyond All Reasonable Doubt Marketing, spoke about “Marketing the Boutique Law Firm” to the Palm Beach County Bar Association’s Solo and Small Firm Practitioners at a luncheon on December 1, 2006.

The presentation focused on how to market and advertise solo and small law firms to get qualified clients in the door.
Sailer discussed the six principles of law firm marketing. “If you don’t have a brand, don’t bother marketing your firm,” Sailer told participants. “Marketing is an investment, not an expense. Today successful firms are spending between 5-10% of their revenue on marketing. If you look at marketing as an expense, you’ll get what you pay for,” she added,
